Patents are filed at the Octrooicentrum Nederland ( Dutch Patent Office ), a governmental organization in The Netherlands similar to the United States Patent and Trademark Office. Trademarks are filed at the Benelux Office for Intellectual Property "BOIP".
What is the meaning of the word "Merkengemachtigde" (Trademark Attorney) in Holland?
The Dutch word for Trademark Atorney ( merkengemachtigde ) is not protected by law in Holland. It has no legal significance. Anyone who is born in the EU may practice as a merkengemachtigde and register a Benelux * trademark for himself, or on behalf of others. So the word merkengemachtigde is no guaranty for quality.

Dutch Patent Attornys are educated in all fields of IP-rights including Copyrights, Trademarks and Designs. Dutch Attorneys at Law can follow additional courses to learn the ins and outs of Trademarks and Designs legislation. In order to become a member of the Benelux Professional Association of Trademark and Design Attorneys ( Beneluxvereniging voor Merken- en Modellenrecht / BMM ) they have to be introduced by two older members and pass a number of examinations.

The word "octrooigemachtigde" IS protected by law.
You can find the names of all registered Patent Attorneys in the Patent Attorney Register, which is kept by Octrooicentrum Nederland. Just click the [zoek] (= search) button to display the list. You will find Dutch Patent Attorneys as well as European Patent Attorneys in the list. European Patent Attorneys have followed additional training in European patent legislation and passed their exams.
